On any given day in Ohio, over 60% of the people in our jails are there not because they’ve been convicted of a crime, but simply because they can’t afford to pay cash bail. The most recent statewide estimate showed that in 2018, there were nearly 12,600 people incarcerated pretrial on any given day. People who are in jail because they can’t afford cash bail risk losing their jobs, their homes, their cars, and even custody of their kids.
Cash bail is incompatible with the concept of equal justice under the law. It keeps poor people in jail while wealthier people accused of the exact same crimes can buy their freedom.
Keeping so many people in jail is a waste of tax dollars. Conservative estimates show bail reform could save Ohio upwards of $250 million each year. It actually saves taxpayers.
Bail is not a retention solution. There have been cases of the wealthy who post bail and then go on to commit serious crimes while out on bail. The bill would set 48 hours for a retention hearing for serious crimes.
